Dear Sirs,

Commercial Information Circular No. 388/2009

European Union (EU)* : Termination of the Partial Interim Review of the Anti-dumping Measures on Imports of Certain Plastic Sacks and Bags Originating in the Mainland of China

Further to Commercial Information Circular No. 357/2008 of 11 July 2008, the European Commission (the Commission) has published a regulation to terminate the partial interim review of the anti-dumping measures imposed on certain plastic sacks and bags originating in the Mainland of China. The regulation can be accessed through the following link :
http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2009:197:0020:0021:EN:PDF

DETAILS

  1. The partial interim review was initiated on the basis of a request lodged by CeDo Shanghai Limited (the applicant), which alleged that the circumstances on the basis of which measures were established have changed and that these changes are of a lasting nature. Therefore, the continued imposition of measures at the existing level is no longer necessary to offset dumping.

  2. By a letter of 24 March 2009, the applicant withdrew its request for the partial interim review. As a result, the Commission decided that the review be terminated without amending the anti-dumping measures currently in force.

BACKGROUND

  1. Definitive anti-dumping duty on imports of certain plastic sacks and bags originating in, inter alia, the Mainland of China has been imposed since 30 September 2006. The current rate of duty is 28.8% of the net, free-at-Community-frontier price before duty (except for eight companies with individual duty rates ranging from 4.3% to 12.8%).
