European Union (EU)* : Extension of the Definitive Anti-dumping Duty Imposed on Imports of Hand Pallet Trucks and their Essential Parts Originating in the Mainland of China to Imports of the Same Product Consigned from Thailand, Whether Declared as Originating in Thailand or Not

Further to Commercial Information Circular No. 476/2008 of 22 September 2008, the Council of the EU (the Council) has published a regulation to extend the definitive anti-dumping duty imposed on imports of hand pallet trucks and their essential parts originating in the Mainland of China to imports of the same product consigned from Thailand, whether declared as originating in Thailand or not. DETAILS

  1. The European Commission (the Commission) published a regulation on 20 September 2008 to initiate an investigation into the alleged circumvention of anti-dumping measures imposed on imports of hand pallet trucks and their essential parts originating in the Mainland of China by imports of the same product consigned from Thailand.

  2. Based on the findings of the circumvention investigation, the Council has decided that with effect from 17 June 2009, the definitive anti-dumping duty imposed on imports of hand pallet trucks and their essential parts, i.e. chassis and hydraulics, originating in the Mainland of China, falling within CN codes ex 8427 90 00 and ex 8431 20 00 (TARIC codes 8427 90 00 11 and 8431 20 00 11), is extended to imports of the same product consigned from Thailand, whether declared as originating in Thailand or not.

  3. The Commission may authorise by decision the exemption of imports which do not circumvent the anti-dumping measures from the anti-dumping duty extended by this regulation. Requests for exemption shall be made in writing in one of the official languages of the EU and must be signed by a person authorised to represent the applicant.   4. With the extension of the anti-dumping duty, the registration requirement of imports of the product concerned consigned from Thailand, whether declared as originating in Thailand or not, is discontinued.

BACKGROUND

  1. Definitive anti-dumping duties on imports of hand pallet trucks and their essential parts originating in the Mainland of China has been imposed since 22 July 2005 at a rate of 46.7% of the net, free-at-Community-frontier price before duty (except for four companies with individual duty rates ranging from 7.6% to 39.9%).

  2. The Commission, on its own initiative, decided to investigate the possible circumvention of the anti-dumping measures by means of assembly operations in Thailand of the product under investigation (for details, please refer to Commercial Information Circular No. 476/2008).
