European Union (EU)* : Initiation of a Partial Interim Review of the Anti-dumping Measures on Imports of Certain Castings Originating in the Mainland of China

Further to Commercial Information Circular No. 182/2009 of 9 April 2009, the European Commission (the Commission) has published a notice to initiate a partial interim review of the anti-dumping measures imposed on imports of certain castings originating in the Mainland of China. Ground for the Review

  1. The Commission has decided on its own initiative to initiate a review on 10 June 2009. The review is limited in scope to the examination of the form of the measure and in particular to the examination of the acceptability and workability of undertakings offered by certain exporting producers.
  2. The Commission has received a request by two exporting producers of the product concerned, XianXian Guozhuang Precision Casting Co. Ltd. and Weifang Stable Casting Co. Ltd, to become a part of the joint undertaking accepted by the Commission in connection with the review.

Review Procedures

  1. Salient points of the partial interim review are set out below-
    (a) Date of Publication of the Notice of Initiation : 10 June 2009
    (b) Product Coverage : Castings of non-malleable cast iron of a kind used to cover and/or give access to ground or subsurface systems, and parts thereof, whether or not machined, coated or painted or fitted with other materials, excluding fire hydrants, classifiable within CN codes 7325 10 50, 7325 10 92 and ex 7325 10 99. (The CN codes are given only for information.)
    (c) Procedures :

    The Commission will examine any requests to become part of the joint undertaking submitted by other exporting producers on the condition that these producers have been granted the "New Exporting Producer Treatment". Interested exporting producers fulfilling the above mentioned condition must submit their undertaking offers within 40 days from 10 June 2009.

    All interested parties must make themselves known, present their views and provide any other information within 40 days from 10 June 2009, unless otherwise specified. They may also apply to be heard within 40 days from 10 June 2009.

    All correspondence must be made in writing (not in electronic format, unless otherwise specified) indicating the name, address, e-mail address, telephone and fax numbers of the interested party and should be sent to the following address :

    If interested parties consider that they are encountering difficulties in the exercise of their rights of defence, they may request the intervention of the Hearing Officer, who offers, where necessary, mediation on procedural matters affecting the protection of their interests in this proceeding, in particular, with regard to issues concerning access to the file, confidentiality, extension of time limits and the treatment of written and/or oral submission of views.     (d) Investigation Schedule ; Investigation will be concluded within 15 months from 10 June 2009.

BACKGROUND

  1. Definitive anti-dumping duty on imports of certain castings originating in the Mainland of China has been imposed since 30 July 2005 at a rate of 47.8% of the net, free-at-Community-frontier price before duty (except for a number of companies with individual duty ranging from 0% to 37.9%).
