European Union (EU)* : Suspension of the Definitive Anti-dumping Duties on Imports of Glyphosate originating in the Mainland of China

Further to Commercial Information Circular No. 237/2004 of 5 October 2004, the European Commission (the Commission) has published a decision to suspend the definitive anti-dumping duties on imports of glyphosate originating in the Mainland of China for a period of nine months. DETAILS

  1. The Commission received information from Audace (an association of users and distributors of the product concerned) on a change of market conditions which occurred after the expiry review investigation period (i.e. from 1 January 2002 to 31 December 2002), and such changes would justify the suspension of the measures currently in force. Such changes include increase in market prices in the Community, and improvements in the situation of the Community industry in terms of sales volume and value, production costs and profits. The Commission considered that the injury linked to the imports of the product concerned originating in the Mainland of China is unlikely to resume as a result of the suspension of the anti-dumping measures, and decided to suspend the measures for nine months starting from 16 May 2009.

  2. Should the situation which led to the suspension changes subsequently, the Commission may reinstate the anti-dumping measures by repealing the suspension of the anti-dumping duties immediately.

BACKGROUND

  1. The Council of the EU imposed on 19 February 1998 a definitive anti-dumping duty on imports of glyphosate originating in the Mainland of China at a rate of 24% of the net, free-at-Community-frontier price before duty. Following an interim review, the anti-dumping duty was revised to 48% since 26 May 2000. As a result of a circumvention investigation, the anti-dumping duty was extended to imports of the same products consigned from Malaysia or Chinese Taipei with effect from 1 February 2002.

  2. An expiry review on the anti-dumping measures was initiated on 15 February 2003. On the basis of the results of the review investigations, the Council decided to maintain the definitive anti-dumping measures on the product concerned and to lower the level of the anti-dumping duty to 29.9% with effect from 1 October 2004.
