European Union (EU)* : Termination of the Partial Interim Review of the Anti-dumping Measures on Imports of Hand Pallet Trucks and Their Essential Parts Originating in the Mainland of China

Further to Commercial Information Circular No. 519/2007 of 19 December 2007, the European Commission (the Commission) has published a regulation to terminate the partial interim review of the anti-dumping measures imposed on imports of hand pallet trucks and their essential parts originating in the Mainland of China. DETAILS

  1. The partial interim review was initiated on the basis of a request lodged by Yale (Hangzhou) Industrial Products Co. Ltd (the applicant), which alleged that the circumstances on the basis of which measures were established have changed and that these changes are of a lasting nature. Therefore, the continued imposition of measures at the existing level, which were based on the level of dumping previously established, appeared to be no longer necessary to offset dumping.

  2. Based on findings of the investigation, it was concluded that the applicant has not fulfilled the conditions for market economy treatment and individual treatment. The applicant was not granted either market economy treatment or individual treatment. The situation of the applicant has thus not changed with respect to the original investigation. Therefore, the review should be terminated without amending the applicable measure.

  3. Moreover, by a letter dated 22 January 2009 to the Commission, the applicant withdrew its request for the partial interim review.

  4. As a result, the Commission decided that the review be terminated without amending the anti-dumping measures currently in force. The anti-dumping duty established during the original investigation, i.e. 46.7%, should be maintained as far as the applicant is concerned.

BACKGROUND

  1. Definitive anti-dumping duty on imports of hand pallet trucks and their essential parts originating in the Mainland of China has been imposed since 22 July 2005. The current rate of duty is 46.7% of the net, free-at-Community-frontier price before duty (except for four companies with individual duty rates ranging from 7.6% to 39.9%).
