European Union (EU)* : Repeal of the Anti-dumping Measures and Termination of the Anti-dumping Proceeding on Imports of Ferro Molybdenum Originating in the Mainland of China

Further to Commercial Information Circular No. 429/2006 of 1 November 2006 and No. 282/2007 of 23 July 2007, the Council of the EU has published a regulation to repeal the anti-dumping measures and terminate the interim review of the anti-dumping measures imposed on imports of ferro molybdenum originating in the Mainland of China. DETAILS

  1. The European Commission initiated an interim review of the anti-dumping measures on the product concerned on 31 October 2006. The examination revealed that the spare production capacity in the Mainland of China would not lead to a resumption of significant exports to the European Community (the Community) if the anti-dumping measures are allowed to expire. The Chinese ferro molybdenum industrial policy aims at restricting exports and there is no obvious price incentive which could divert sales to the Community. There are therefore no reasons to believe that the volume of exports from the Mainland of China, at least in the foreseeable future, will be significant, and any such exports are not expected to be made at dumped prices.

  2. It is concluded that since there is no likelihood of resumption of any significant quantities of dumped exports of the product concerned to the Community from the Mainland of China, the anti-dumping measures should be repealed and the proceeding terminated from 31 January 2008.

BACKGROUND

  1. Definitive anti-dumping duty on imports of ferro molybdenum originating in the Mainland of China has been imposed since 7 February 2002 at the rate of 22.5% of the net, free-at-Community-frontier price before duty. The anti-dumping duty has been suspended since 25 October 2006 because there was a change of market conditions, including substantial drop in import penetration of the product concerned from the Mainland of China, increase in market price in the Community and improvements in the situation of the Community industry in terms of sales, production volumes and profits.
