Dear Sirs,

Commercial Information Circular No. 469/2008

European Union (EU)* : Maintaining the Anti-dumping Duties on Imports of Polyester Staple Fibres Originating in, inter alia, the Mainland of China following a Partial Interim Review

Further to Commercial Information Circular No. 319/2007 of 30 August 2007, the Council of the EU (the Council) has published a regulation to maintain the anti-dumping measures imposed on imports of polyester staple fibres (PSF) originating in, inter alia, the Mainland of China pursuant to a partial interim review. The regulation can be accessed through the following link:
http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2008:247:0001:0016:EN:PDF

DETAILS

  1.
  2. The European Commission initiated a partial interim review on 30 August 2007 to examine whether the continued imposition of the anti-dumping measures imposed on imports of PSF originating in, inter alia, the Mainland of China was against the Community interest. According to the aforesaid regulation, the review investigation revealed that the possible limited advantages to be enjoyed by Community users and importers if anti-dumping duties were to be repealed would clearly be disproportionate compared to the serious disadvantages to the Community industry. Accordingly, the termination of its existing measures on imports from the economies concerned (i.e. Belarus, Korea, Saudi Arabia and the Mainland of China) on Community interest grounds would not be justified. The Council decided to terminate the partial interim review without amending the anti-dumping measures in force.

Background

  1. Definitive anti-dumping duty on imports of PSF originating in, inter alia, the Mainland of China has been imposed since 18 March 2005. The rate of duty is 49.7% of the net, free-at-Community-frontier price before duty (except for six companies with individual duty rates ranging from 4.9% to 26.3%). For details, please refer to the Commercial Information Circular No. 101/2005 of 23 March 2005 which is accessible from the Department's web portal:
