European Union (EU)* : Initiation of a Partial Interim Review of the Anti-dumping Measures on Imports of Certain Finished Polyester Filament Fabrics Originating in the Mainland of China

Further to Commercial Information Circular No. 356/2007 of 24 September 2007, the European Commission (the Commission) has published a notice to initiate a partial interim review of the anti-dumping measures imposed on imports of certain finished polyester filament fabrics (hereafter 'the product concerned') originating in the Mainland of China. Grounds for the Review

  1. The review is initiated at the request of Hüpeden GmbH & Co. KG(the applicant), an importer from Germany, and is limited to the examination of the product scope. The applicant alleges that the product it imports is only used to produce a special adhere tape for insulation of cables within the wiring harness of engines, mainly engines of cars. The specific technical and chemical characteristics of the applicant's product appear to be different from those of the product concerned.

Review Procedure

  1. Salient points of the partial interim review are set out below-
(a) Date of Publication of the Notice of Initiation : 26 June 2008
(b) Product under Review :

Woven fabrics of synthetic filament yarn containing 85% or more by weight of textured and/or non-textured polyester filament, dyed (including dyed white) or printed originating in the Mainland of China, currently classifiable within CN codes 5407 51 00, 5407 52 00, 5407 54 00, 5407 61 10, 5407 61 30, 5407 61 90, 5407 69 10 and 5407 69 90. These CN codes are given only for information.

(c) Procedures :

In order to obtain information for the investigation, the Commission will send questionnaires to the applicant, to the Community industry, to other known producers in the Community, to known importers, to known users and to known exporting producers in the Mainland of China.

All interested parties may in writing present their views, submit questionnaire replies and provide supporting evidence to the Commission within 40 days from 26 June 2008, unless otherwise specified. Interested parties may also apply to be heard by the Commission within the same timeframe.

(d) Investigation Schedule :

The investigation will be concluded within 15 months from 26 June 2008.

Background

  1. Definitive anti-dumping duty on imports of certain finished polyester filament fabrics originating in the Mainland of China had been imposed since 17 September 2005. Subsequent to a re-investigation, the rate of duty was revised to 74.8% of the net free-at-Community-frontier price before duty (except for 46 companies with individual duty rates ranging from 14.1% to 74.8%) with effect from 22 September 2007.
