Commercial Information Circular No. 339/2008

European Union (EU)* : Amendment to the Directive on Plastic Materials and Articles Intended to Come into Contact with Foodstuffs

Further to our Commercial Information Circular No. 207/2008 of 3 April 2008, the European Commission (the Commission) has adopted a Regulation to amend Regulation (EC) No. 372/2007 concerning the transitional migration limits for plasticisers in gaskets in lids intended to come into contact with foods. Details are set out in Commission Regulation (EC) No. 597/2008 (the Regulation). The Regulation can be accessed through the following link :

Commercial Information Circular No. 194/2007 of 3 May 2007 informed the trade that from 1 July 2008, lids containing a gasket should comply with restrictions and specifications laid down in Directive 2002/72/EC. Meanwhile, gaskets in lids should follow the transitional migration limits set out in the Commission Regulation (EC) No. 372/2007 until 30 June 2008. However, the Commission was informed by the food and lid industry that fatty food products packaged with lids tested for compliance are subject to seasonal production and that food producers need some time to test and choose the suitable solution for their products. In this regard, the Commission has decided to extend the transitional period until 30 April 2009.
