European Union (EU) * : Granting "New Exporting Producer Treatment" to Certain Exporting Producers for the Anti-dumping Measures on Imports of Certain Castings Originating in the Mainland of China

Further to Commercial Information Circular No. 289/2005 of 2 August 2005, the Council of the EU has published a regulation announcing its decision to grant "New Exporting Producer Treatment (NEPT)" for the definitive anti-dumping duty on imports of certain castings originating in the Mainland of China to certain exporting producers consequent to NEPT examination. DETAILS

  1. Salient points are set out below –

(a) Product : Castings of non-malleable cast iron of a kind used to cover and/or give access to ground or subsurface systems, and parts thereof, whether or not machined, coated or painted or fitted with other materials, excluding fire hydrants, classifiable within CN codes 7325 10 50, 7325 10 92 and ex 7325 10 99 (TARIC code 7325 10 99 10).
(b) Amended Individual Rate of Duty : The individual duty rate is amended according to Article 1 of the regulation.
(c) Effective Date : 18 May 2008

BACKGROUND

  1. Definitive anti-dumping duty on imports of certain castings originating in the Mainland of China has been imposed since 30 July 2005 at a rate of 47.8% of the net, free-at-Community-frontier price before duty (except for a number of companies with individual duty ranging from 0% to 37.9%).

  2. Exporting producers from the Mainland of China may request to be granted NEPT should they meet the prescribed criteria and be granted the same treatment as that for the cooperating companies not included in the sample during the anti-dumping investigation. A total of nine companies have requested to be granted NEPT.
