Dear Sirs,

Commercial Information Circular No. 180/2008

European Union (EU)* : Result of a Partial Interim Review of the Anti-dumping Measures Imposed on Imports of Certain Plastic Sacks and Bags Originating in the Mainland of China

Further to Commercial Information Circular No. 119/2007 of 13 March 2007, the Council of the EU has published a regulation to amend the anti-dumping measures imposed on imports of certain plastic sacks and bags originating in the Mainland of China pursuant to a partial interim review. The regulation can be accessed through the following link :
http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=OJ:L:2008:076:0008:0012:EN:PDF.

DETAILS

  1. The Commission has decided on its own initiative to initiate a partial interim review on 9 March 2007. The review is limited in scope to dumping aspects concerning one exporting producer, Xinhui Alida Polythene Limited (the company). Information at the Commission's disposal indicated that market economy conditions prevailed for the company, and the company's sales pattern, both in terms of quantity and destination, had changed in a lasting way. Furthermore, a comparison of normal value based on the company's own costs/domestic prices and its export prices would lead to a reduction of dumping significantly below the level of the current measure. Therefore, the continued imposition of measures at the existing levels, which were based on the level of dumping previously established, would no longer be necessary.

  2. As a result of the partial interim review, the rate of duty imposed to the company is reduced to 4.3% of the of the net, free-at-Community-frontier price before duty.

BACKGROUND

  1. Definitive anti-dumping duties on certain plastic sacks and bags originating in, inter alia, the Mainland of China have been imposed since 30 September 2006. The current duty in force is 28.8% of the net, free-at-Community-frontier price before duty (for more details, please refer to Commercial Information Circular No. 388/2006).
