European Union (EU)* : Imposition of a Definitive Anti-dumping Duty on Imports of Coke of Coal Originating in the Mainland of China
Further to Commercial Information Circular No. 352/2007 of 19 September 2007, the Council of the EU has published a regulation to impose a definitive anti-dumping duty on imports of coke of coal in pieces with a diameter of more than 80 mm (Coke 80+) originating in the Mainland of China. - Salient points are set out below -
(a) Product | : |
Coke of coal in pieces larger than 80mm in maximum diameter (Coke 80+), falling within CN code ex 2704 00 19 (TARIC code 2704 00 19 10). |
(b) Rate of Duty | : |
(i) The difference between the minimum import price of EUR 197 per tonne and the net, free-at-Community-frontier price before duty, in all cases where the latter is less than the minimum import price.
(ii) Anti-dumping duty shall also apply, pro rata, when the shipment of coke of coal contains mixtures of coke of coal in pieces with a diameter of more than 80mm and coke of coal in pieces with smaller diameters, unless it is determined that the quantity of coke of coal in pieces with a diameter of more than 80mm does not constitute more than 20% of dry net weight of the mixed shipment. |
(c) Effective Date | : | 19 March 2008 |
(d) Duration | : | Five years |
(e) Collection of Duty | : |
Amounts secured by way of provisional anti-dumping duties on imports of coke of coal since 20 September 2007 shall be definitively collected. The amounts secured in excess of the amount of the definitive duties shall be released. |
