European Union (EU)* : Termination of the Anti-dumping Proceeding Concerning Imports of Polyvinyl Alcohol (PVA) Originating in, inter alia, the Mainland of China

Further to Commercial Information Circular No. 349/2007 of 18 September 2007, the European Commission (the Commission) published a decision to terminate the anti-dumping proceeding concerning imports of polyvinyl alcohol (PVA) originating in, inter alia, the Mainland of China.   2. The Commission's investigation and analysis found that it cannot be confirmed that the dumped imports have had a material impact on the injury of the Community industry. Given (i) the relatively limited and only slightly increasing market share of the dumped imports from the Mainland of China and the much more important and slightly increasing market share of Community industry sales during the investigation period; and (ii) the limited undercutting practiced by imports from the Mainland of China, it can be concluded that the low prices on the Community market in a context of increasing raw material prices, which have strongly contributed to the injury suffered by the Community industry, cannot be attributed to the dumped imports from the Mainland of China. It is therefore concluded that in the absence of a causal link between the dumped imports and the injury suffered by the Community industry, the anti-dumping proceeding should be terminated. Amounts secured by way of provisional anti-dumping duties on imports of the product concerned originating in the Mainland of China shall be released.

BACKGROUND

  1. The Commission initiated the proceeding on the basis of a complaint lodged by Kuraray Specialties Europe GmbH representing more than 25% of the total Community production of PVA. It was alleged that imports of the concerned product originating in, inter alia, the Mainland of China were being dumped, thereby causing material injury to the Community industry. The Commission has imposed a provisional anti-dumping duty on imports of the product concerned originating in the Mainland of China since 19 September 2007.
