European Union (EU)* : Result of the Review of the Extension of the Anti-dumping Duty on Imports of Bicycles Originating in the Mainland of China to Imports of Certain Bicycle Parts from the Mainland of China

Further to Commercial Information Circular No.469/2006 of 28 November 2006, the Council of the EU has published a regulation to maintain the extension of the anti-dumping duty on imports of bicycles originating in the Mainland of China to imports of certain bicycle parts from the Mainland of China. DETAILS

  1. A review to assess the need for continuation of the extension of the anti-dumping duty on imports of bicycles to certain bicycle parts originating in the Mainland was initiated on 28 November 2006 by the European Commission. The review shows that currently no circumvention of the anti-dumping measure by companies having been granted an exemption from the extended measure appears to be taking place, but the risk of recurrence of circumvention cannot be fully excluded. It was therefore decided that extended anti-dumping measure shall be maintained, in order to ensure that the principal measure, i.e. the anti-dumping duty on bicycles, is effective.

BACKGROUND

  1. Definitive ant-dumping duty on imports of bicycles originating in the Mainland of China has been imposed since 10 September 1993. Based on the findings of a circumvention investigation, the Council of the EU extended with effect from 19 January 1997 the definitive anti-dumping duty imposed on imports of bicycles to imports of certain bicycle parts originating in the Mainland of China. Subsequent to an interim review, the subject anti-dumping duty has been increased to 48.5% and imposed for a new five-year term starting from 15 July 2005. Bicycle assemblers in the EU could however request for exemption from the extended anti-dumping measures if they could prove, among other things, that their assembly operations did not circumvent the EU's anti-dumping duty imposed on bicycles originating in the Mainland of China.
