European Union (EU)* : Extension of the Definitive Anti-dumping Duty Imposed on Imports of Silicon Originating in the Mainland of China to Imports of the Same Products Consigned from the Republic of Korea, Whether Declared as Originating in the Republic of Korea or Not

Further to Commercial Information Circular No. 152/2006 of 20 April 2006, the Council of the EU (the Council) has published a regulation to extend the definitive anti-dumping duty imposed on imports of silicon originating in the Mainland of China to imports of the same products consigned from the Republic of Korea, whether declared as originating in the Republic of Korea or not. DETAILS

  1. The European Commission (the Commission) published a regulation on 20 April 2006 to initiate an investigation into the alleged circumvention of anti-dumping measures imposed on imports of silicon originating in the Mainland of China by imports of the same products consigned from the Republic of Korea.
  2. Based on the findings of the circumvention investigation, the Council has decided that with effect from 20 January 2007, the definitive anti-dumping duty imposed on imports of silicon originating in the Mainland of China, falling within CN code 2804 69 00, is extended to imports of silicon, falling within CN code ex 2804 69 00 (TARIC code 2804 69 00 10), consigned from the Republic of Korea, whether declared as originating in the Republic of Korea or not.
  3. The Commission may authorise by decision the exemption of imports which do not circumvent the anti-dumping measures from the anti-dumping duty extended by this regulation. Requests for exemption should be made in writing in one of the official languages of the EU and must be signed by a person authorised to represent the applicant. The request must be sent to the following address :

  4. With the extension of the anti-dumping duty, the registration requirement of imports of silicon consigned from the Republic of Korea, whether declared as originating in the Republic of Korea or not, is discontinued.

BACKGROUND

  1. Definitive anti-dumping duty on silicon originating in the Mainland of China has been imposed since 17 December 1997. Subsequent to an expiry review initiated on 12 October 2002, the Commission published a regulation on 4 March 2004 to maintain the duty. The current duty in force is 49% of the net, free-at-Community-frontier price before duty.
