European Union (EU)* : Imposition of a Definitive Anti-dumping Duty on Imports of Silico-manganese and Suspension of the Definitive Anti-dumping Duty of the Same Product Originating in, inter alia, the Mainland of China

Further to Commercial Information Circular No. 348/2006 of 6 September 2006, the Council of the EU has published a regulation to impose a definitive anti-dumping duty on imports of silico-manganese originating in, inter alia, the Mainland of China. At the same time, the European Commission (the Commission) has published a decision to suspend the above-mentioned definitive anti-dumping measures for a period of nine months. DETAILS

  1. Salient points concerning the regulation and decision are set out below –

    (a) Product :

    Silico-manganese (including ferro-silico-manganese), falling within CN codes 7202 30 00 and ex 8111 00 11 (TARIC code 8111 00 11 10).

    (b) Rate of Duty :

    8.2% of the net, free-at-Community-frontier price before duty.

    (c) Effective Date :  6 December 2007
    (d) Duration : Five years
    (e) Suspension of Anti-dumping Duty :

    The definitive anti-dumping duty is suspended for nine months from 6 December 2007.

  2. Since the original investigation period, an increase in world prices for silico-manganese was observed, indicating a change of the market situation and conditions. In view of this, the Commission has carried out a further investigation to assess the recent evolution of volumes and prices of the product concerned, and their impact on the injury suffered by the Community industry as well as the overall Community interest.
     

  3. Given the temporary change in market conditions observed by the Commission, and in particular the high level of prices of silico-manganese existing on the Community market, which is far higher than the injurious price level found in the original investigation, together with the alleged demand-supply imbalance of the product concerned, the Commission considered that the injury linked to the imports of the product concerned originating in, inter alia, the Mainland of China is unlikely to resume as a result of the suspension, and decided to suspend for nine months the measures in force.
     

  4. The Commission will monitor the development of imports and the prices of the product concerned. Should a situation arise at any time in which increased volumes at dumped prices of the product concerned from, inter alia, the Mainland of China resume and consequently cause injury to the Community industry, the Commission will take the necessary steps to reinstate the antidumping duty.
