Commercial Information Circular No. 444/2007

European Union (EU)* : Amendment to the Regulation Imposing a Definitive Anti-dumping Duty on Certain Plastic Sacks and Bags Originating in, inter alia, the Mainland of China

Further to Commercial Information Circular No. 388/2006, the Council of the EU has published a regulation clarifying the product definition of the definitive anti-dumping duty on imports of certain plastic sacks and bags originating in, inter alia, the Mainland of China. DETAILS

  1. Salient points are set out below -
(a) Amendment of Definition of "Plastic Sacks and Bags" : Plastic sacks and bags, containing at least 20 % by weight of polyethylene and of sheeting of a thickness not exceeding 100 micrometres (μm), falling within CN codes ex 3923 21 00, ex 3923 29 10 and ex 3923 29 90 (TARIC codes 3923 21 00 20, 3923 29 10 20 and 3923 29 90 20). (Words in bold face are newly added.)
(b) Effective Date of the Amendment : 23 November 2007

BACKGROUND

  1. Definitive anti-dumping duties on certain plastic sacks and bags originating in, inter alia, the Mainland of China have been imposed since 30 September 2006. The current duty in force is 28.8% of the net, free-at-Community-frontier price before duty (for more details, please refer to Commercial Information Circular No. 388/2006).
     
  2. It has been brought to the European Commission's attention that the terminology "thickness of a bag" could cause confusion during the custom clearance process and it has therefore been decided to clarify the issue through this regulation.
