European Union (EU)* : Result of Expiry Review of the Anti-dumping Measures on Imports of Integrated Electronic Compact Fluorescent Lamps (CFL-i) Originating in the Mainland of China and on Imports of the Same Product Consigned from the Socialist Republic of Vietnam, the Islamic Republic of Pakistan and the Republic of the Philippines

Further to Commercial Information Circular No. 271/2006 of 19 July 2006, the Council of the EU has published a regulation announcing the decision to maintain the anti-dumping duty imposed on imports of integrated electronic compact fluorescent lamps (CFL-i) originating in the Mainland of China and on imports of the same product consigned from Vietnam, Pakistan and the Philippines consequent to an expiry review.   2. Salient points are set out below –

(a) Product :

Electronic compact fluorescent discharge lamps functioning on alternating current (including electronic compact fluorescent discharge lamps functioning on both alternating and direct current), with one or more glass tubes, with all lighting elements and electronic components fixed to the lamp foot, or integrated in the lamp foot, falling within CN code ex 8539 31 90 (TARIC code 8539 31 90 95).

(b) Rate of Duty :

66.1% of the net, free-at-Community-frontier price before duty (except for 8 companies whose individual duty rates range from 0% to 59.5%).

(c) Effective Date : 18 October 2007
(d) Duration : One year
  1. With effect from 18 October 2007, definitive anti-dumping duty of 66.1% and applicable to imports originating in the Mainland of China is imposed on imports of the same product consigned from the Socialist Republic of Vietnam, the Islamic Republic of Pakistan and the Republic of the Philippines, whether declared as originating in the Republic of Vietnam, the Islamic Republic of Pakistan and the Republic of the Philippines or not (TARIC code 8539 31 90 92). The duty will be in force for one year from 18 October 2007.

BACKGROUND

  1. Definitive anti-dumping duty on imports of CFL-i originating in the Mainland of China has been imposed since 20 July 2001. The rate of duty is 66.1% of the net, free-at-Community-frontier price before duty (except for eight companies whose individual duty rates range from 0% to 59.5%). Following a circumvention investigation, the Council of the EU has decided that with effect from 10 June 2005, the definitive anti-dumping duty imposed on imports of CFL-i has extended to imports of the same products consigned from Vietnam, Pakistan and/or the Philippines, whether declared as originating in Vietnam, Pakistan or the Philippines or not.
     

  2. In April 2006, the Community Federation of Lighting Industry of CFL-i requested an expiry review alleging that there would be a continuation of dumping and injury to the Community industry with the expiry of the anti-dumping duty. The Commission therefore initiated an expiry review on 19 July 2006. The anti-dumping duty remained in force pending the outcome of the expiry review.
