European Union (EU)* : Result of Reinvestigation of the Anti-dumping Measures on Imports of Certain Finished Polyester Filament Fabrics Originating in the Mainland of China

Further to Commercial Information Circular No. 13/2007 of 2 January 2007, the Council of the EU (the Council) has published a regulation to amend the definitive anti-dumping duty imposed on certain finished polyester filament fabrics originating in the Mainland of China subsequent to a reinvestigation. Salient Points are set out below -

(a) Product :

Woven fabrics of synthetic filament yarn containing 85% or more by weight of textured and/or non-textured polyester filament, dyed (including dyed white) or printed, falling within CN codes ex 5407 51 00, 5407 52 00, 5407 54 00, ex 5407 61 10, 5407 61 30, 5407 61 90, ex 5407 69 10 and ex 5407 69 90. These CN codes are given for information only.

(b) Revised Duty Rates  :

74.8% of the net free-at-Community-frontier price before duty (except for 46 companies with individual duty rates ranging from 14.1% to 74.8%)

(c) Effective date :

22 September 2007

DETAILS

  1. Definitive anti-dumping duty on imports of certain finished polyester filament fabric originating in the Mainland of China had been imposed since 17 September 2005 at a rate of 56.2% of the net free-at-Community-frontier price before duty (except for the 45 companies with individual duty rates ranging from 14.1% to 56.2%).
     
  2. On the basis of a request lodged by AIUFFASS on behalf of producers representing more than 30% of the Community production of certain finished polyester filament fabrics, the European Commission initiated a reinvestigation on 28 December 2006 to ascertain whether the existing anti-dumping measures have had an effect on export prices, resale prices or subsequent selling prices in the Community. 
     
  3. Subsequent to the reinvestigation, the Council concluded that none of the exporters / producers included in the sample for reinvestigation absorbed the anti-dumping duty in force and, therefore, no absorption duty should be established for them. However, given the high level on non-cooperation, the Council considered that an absorption duty of 18.6%, established on the basis of the best information available which is the data available under the Eurostat import statistics, should be applied to all non-cooperating exporters / producers in the Mainland of China. The level of anti-dumping duty should therefore be revised accordingly except for those exporters / producers in the Mainland of China which agreed to cooperate and to be included in the sample for re-investigation.
     
  4. Traders are requested to note that the Council may re-examine the situation of exporters that could not cooperate in this reinvestigation in case they come forward with evidence showing that they were not absorbing the anti-dumping measures in force during the current investigation period.
