Commercial Information Circular No. 352/2007

European Union (EU)* : Imposition of Provisional Anti-dumping Duty on Imports of Coke of Coal Originating in the Mainland of China

Further to Commercial Information Circular No. 509/2006 of 20 December 2006, the European Commission (the Commission) has published a regulation to impose a provisional anti-dumping duty on imports of coke of coal in pieces with a diameter of more than 80mm ('Coke 80+') originating in the Mainland of China. The regulation can be accessed through the following link :

  1. Salient points are set out below -
(a) Product :

Coke of coal in pieces larger than 80mm in maximum diameter (Coke 80+), falling within CN code ex 2704 00 19 (TARIC code 2704 00 19 10).

(b) Rate of Duty :

(i) The difference between the minimum import price of EUR 227 per tonne and the net, free-at-Community-frontier price before duty, in all cases where the latter is less than the minimum import price.

(ii) Anti-dumping duty shall also apply when the shipment of coke of coal contains mixtures of coke of coal in pieces with a diameter of more than 80mm and coke of coal in pieces with smaller diameters, unless it is determined that the quantity of coke of coal in pieces with a diameter of more than 80mm does not constitute more than 20 % of dry net weight of the mixed shipment.

(iii) In case where goods have been damaged before entry into free circulation and, therefore, the price actually paid or payable is apportioned for the determination of the customs value, the minimum import price shall be reduced by a percentage which corresponds to the apportioning of the price actually paid or payable.

(c) Effective Date : 20 September 2007 (the duty will apply for 6 months).
(d) Collection of Duty :

The release of the product for free circulation in the Community shall be subject to the provision of a security equivalent to the amount of the provisional duty.

(e) Time Limit for Comments :

Interested parties may request disclosure of the essential facts and considerations on the basis of which the regulation was adopted, make their views known in writing and apply to be heard by the Commission within one month from 20 September 2007.
