European Union (EU)* : Initiation of a Partial Interim Review of the Anti-dumping Measures on Imports of Synthetic Staple Fibres of Polyesters Originating in, inter alia, the Mainland of China

Further to Commercial Information Circular No. 161/2007 of 12 April 2007, the European Commission (the Commission) has published a notice to initiate another partial interim review of the anti-dumping measures imposed on imports of synthetic staple fibres of polyesters (hereafter 'the product concerned') originating in, inter alia, the Mainland of China. Grounds for the Review

  1. The Commission has decided on its own initiative to initiate a new partial interim review on 30 August 2007. There is information indicating that, due to changes in the Community market since the investigation periods used in the investigations that led to the imposition of the existing measures, the continued imposition of the measures may no longer be in the Community interest. In particular, the Commission concluded in its anti-dumping investigation concerning imports of the product concerned originating in Malaysia and Chinese Taipei, that it would not be in the Community interest to impose measures on imports from those economies. Therefore, it is appropriate to review the need for the continued imposition of the existing measures.

Review Procedure

  1. Salient points of the partial interim review are set out below -
(a) Date of Publication of the Notice of Initiation : 30 August 2007
(b) Product Coverage : Synthetic staple fibres of polyesters, not carded, combed or otherwise processed for spinning, currently classifiable within CN code 5503 20 00 (this CN code is given for information only).
(c) Scope of the Review : The review is limited to the examination of whether or not the continued imposition of the measures is not against the Community interest.
(d) Procedures :

In order to obtain information for the investigation, the Commission will send questionnaires to the Community producers, to the importers and to the users.

All interested parties may in writing present their views, submit questionnaire replies and provide supporting evidence to the Commission within 40 days from 30 August 2007, unless otherwise specified. Interested parties may also apply to be heard by the Commission within the same timeframe.

(e) Investigation Schedule : The investigation will be concluded within 15 months from 30 August 2007.

Background

  1. Definitive anti-dumping duty on imports of polyester staple fibres originating in, inter alia, the Mainland of China has been imposed since 18 March 2005. The rate of duty is 49.7% of the net, free-at-Community-frontier price before duty (except for individual companies with duty rates ranging from 4.9% to 26.3%).
