European Union (EU)* : Initiation of a Partial Interim Review of the Anti-dumping Measures on Imports of Hand Pallet Trucks and Their Essential Parts Originating in the Mainland of China

Further to Commercial Information Circular No. 184/2007 of 26 April 2007, the European Commission (the Commission) has published a notice to initiate another partial interim review of the anti-dumping measures imposed on imports of hand pallet trucks and their essential parts (HPT) originating in the Mainland of China. Grounds for the Review

  2. The Commission has decided on its own initiative to initiate a new partial interim review on 7 August 2007. There is information indicating that certain products (so-called highlifters, stackers, scissorlifts and weighing trucks), which could allegedly fall under the product scope of HPT, appear to be distinct from HPT due to their specific functions and end uses. There appears to be no interchangeability between these products and HPT and therefore it is appropriate to review the product scope for the anti-dumping measures.

Review Procedures

  1. Salient points of the partial interim review are set out below –
(a) Date of Publication of the Notice of Initiation : 7 August 2007
(b) Product Coverage : Hand pallet trucks and their essential parts, i.e. chassis and hydraulics, currently classifiable within CN codes ex 8427 90 00 and ex 8431 20 00 (the CN codes are given only for information).
(c) Procedures :

The review is limited to the examination of the product scope.

In order to obtain information for the investigation, the Commission will send questionnaires to the Community industry, known importers, known exporting producers in the Mainland of China and the authorities of the Mainland of China.

All interested parties may make their views known in writing and submit questionnaire replies or any other information to the Commission, and also apply to be heard by the Commission within 40 days from 7 August 2007, unless otherwise specified.

(d) Investigation Schedule : Investigation will be concluded within 15 months from 7 August 2007.

Background

  1. Definitive anti-dumping duty on imports of HPT originating in the Mainland of China has been imposed since 22 July 2005 at a rate of 46.7% of the net, free-at-Community-frontier price before duty (except for four companies with individual duty rates ranging from 7.6% to 39.9%).
