Dear Sirs,

Commercial Information Circular No. 282/2007

European Union (EU)* : Extending the suspension of the Anti-dumping Measures on Imports of Ferro Molybdenum Originating in the Mainland of China

Further to Commercial Information Circulars No. 421/2006 of 25 October 2006 and 429/2006 of 1 November 2006, the European Council (the Council) has published a regulation to extend the suspension of the definitive anti-dumping duty on imports of ferro molybdenum originating in the Mainland of China. The regulation can be accessed through the following link:
http://eur-lex.europa.eu/LexUriServ/site/en/oj/2007/l_190/l_19020070721en00010002.pdf.

Details of the Extension

  1.
  2. Since the suspension of the anti-dumping duty starting from 25 October 2006, the situation in the Community market with respect to imports and prices of ferro molybdenum originating in the Mainland has remained unchanged, with only insignificant volumes of the product concerned imported into the Community market. Given that the interim review of the anti-dumping measures initiated on 31 October 2006 has not been concluded yet, the Council considered it appropriate to extend the suspension of the duty until 31 January 2008.

  3. Should a situation arise at any time in which increased volumes at dumped prices of the product concerned resume and consequently cause injury to the Community industry, the European Commission (the Commission) will propose reinstating the anti-dumping duty by repealing the present suspension.

BACKGROUND

  1. Definitive anti-dumping duty on imports of ferro molybdenum originating in the Mainland of China has been imposed since 7 February 2002 at the rate of 22.5% of the net, free-at-Community-frontier price before duty. The anti-dumping duty has been suspended starting from 25 October 2006 for a period of 9 months.

  2. On 31 October 2006, the Commission initiated an interim review of the anti-dumping measures. The review will be concluded by 31 January 2008.
