European Union (EU)* :  Termination of the Partial Interim Review of the Anti-dumping Measures on Imports of Hand Pallet Trucks and Their Essential Parts Originating in the Mainland of China

Further to Commercial Information Circular No. 206/2006 of 1 June 2006, the Council of the EU (the Council) has published a regulation to terminate the partial interim review of the anti-dumping measures imposed on imports of hand pallet trucks and their essential parts originating in the Mainland of China. DETAILS

  1. The European Commission (the Commission) decided on its own initiative to initiate a partial interim review on 31 May 2006 concerning one Mainland exporting producer, Ningbo Ruyi Joint Stock Co., Ltd. (the company). The review is limited in scope to determine whether the company operates under market economy conditions and, if so, to determine whether its individual dumping margin and duty rate should be based on its own costs/domestic prices.
  2. The company has requested market economy treatment (MET). During the investigation it was found that there were other companies related to the company not disclosed in the audited financial statements or in the company's replies to the MET claim form and to the Commission's questionnaire. The failure to disclose all the related parties in the financial statements is a breach of international accounting standards, and casts doubts on the reliability of the company's accounts. The disclosure is also considered necessary for the examination of whether a group of related companies as a whole fulfils the conditions for MET. In the light of the results of the investigation, the Council has decided to terminate the partial interim review without granting MET to the company or amending the level of the duty applicable to the company.

BACKGROUND

  1. Definitive anti-dumping duty on imports of hand pallet trucks and their essential parts originating in the Mainland of China has been imposed since 22 July 2005 at a rate of 46.7% of the net, free-at-Community-frontier price before duty (except for four companies whose individual duty rates range from 7.6% to 39.9%).
