Commercial Information Circular No. 167/2007

European Union (EU)* : Imposition of a Definitive Anti-dumping Duty and Release of the Provisional Duty on Imports of Certain Frozen Strawberries Originating in the Mainland of China

Further to Commercial Information Circular No. 412/2006 of 18 October 2006, the Council of the EU has published a regulation to impose a definitive anti-dumping duty and release the provisional duty collected on imports of certain frozen strawberries originating in the Mainland of China. The regulation can be accessed through the following link:

  1. Salient points are set out below –
(a) Product : Strawberries, uncooked or cooked by steaming or boiling in water, frozen, whether or not containing added sugar or other sweeteners, falling within CN codes 0811 1011, 0811 10 19 and 0811 10 90.
(b) Rate of Duty : The difference between the minimum import price (which ranges from EUR 496.8 to EUR 598 per tonne, depending on the sugar content) and the net free-at-Community-frontier price before duty, if the latter is lower than the former (except for one company whose individual duty rate is 0%). Where it is found that the net free-at-Community-frontier price actually paid by the first independent customer in the Community is below the net free-at-Community-frontier price before duty as resulting from the customs declaration, and is lower than the minimum import price, the fixed anti-dumping duty (which ranges from EUR 169.9 to EUR 204.5 per tonne, depending on the sugar content, except for one company) shall apply. For details, please refer to Article 1 of the regulation.
(c) Effective Date : 18 April 2007
(d)Duration : Five years
(e)Release of Provisional Duty : Amounts secured by way of provisional anti-dumping duty since 19 October 2006 shall be released.
