European Union (EU)* : Termination of the Anti-dumping Proceeding Concerning
Imports of Pentaerythritol Originating in, inter alia, the Mainland of China

Further to Commercial Information Circular No. 29/2006 of 17 January 2006, the European Commission (the Commission) published a decision to terminate the anti-dumping proceeding concerning imports of pentaerythritol originating in, inter alia, the Mainland of China. DETAILS

  1. The Commission's investigation found that the Community industry has suffered material injury and that dumped imports from, inter alia, the Mainland of China have exerted a price pressure on the Community industry's prices. However, dumped imports alone do not seem to explain the sharp drop in the Community industry's profitability during the investigation period (i.e. January - December 2005). Examination of other factors revealed that the injury suffered by the Community industry could be attributed also to the decrease in consumption of the Community market, the export performance of the Community industry as well as imports from other third countries. It is concluded that in the absence of a significant causal link between the dumped imports and the injury suffered by the Community industry, the anti-dumping proceeding should be terminated.

BACKGROUND

  1. The Commission initiated the proceeding on 17 January 2006 on the basis of a complaint lodged by CEFIC (European Chemical Industry Council), representing more than 50% of the total Community production of pentaerythritol. It was alleged that imports of the product concerned were being dumped, thereby causing material injury to the Community industry.
