European Union (EU)* : Initiation of a Reinvestigation of the Anti-dumping Measures on Imports of Certain Finished Polyester Filament Fabrics Originating in the Mainland of China

Further to Commercial Information Circular No. 377/2005 of 17 September 2005, the European Commission (the Commission) has published a notice to initiate a reinvestigation of the anti-dumping measures imposed on imports of certain finished polyester filament fabrics originating in the Mainland of China. A copy of the notice is at Annex (pdf format) for reference.

DETAILS

Grounds for the Re-investigation

  1. On the basis of a request lodged by AIUFFASS on behalf of producers representing more than 30% of the total Community production of certain finished polyester filament fabrics, the Commission initiated a reinvestigation on 28 December 2006 to ascertain whether the existing anti-dumping measures have had an effect on export prices, resale prices or subsequent selling prices in the Community.

Reinvestigation Procedure

  1. Salient points of the reinvestigation are set out below :
(a) Date of Publication of the Notice of Initiation : 28 December 2006
(b) Product Coverage : Woven fabrics of synthetic filament yarn containing 85% or more by weight of textured and/or non-textured polyester filament, dyed (including dyed white) or printed, falling within CN codes ex 5407 51 00, 5407 52 00, 5407 54 00, ex 5407 61 10, 5407 61 30, 5407 61 90, ex 5407 69 10 and ex 5407 69 90. These CN codes are given for information only.
(c) Procedures :

In view of the apparent large number of parties involved, the Commission may apply sampling technique. All exporters/producers, or representatives acting on their behalf should, within 15 days from 28 December 2006, make themselves known to the Commission and provide information as requested in paragraph 5(a)(i) of the notice in question.

In order to obtain information for the reinvestigation, the Commission will send questionnaires to the sampled exporters/producers in the Mainland of China, any association of exporters/producers, sampled importers, any association of importers named in the request or which co-operated in the investigation leading to the measures subject to the present review, and to the authorities of the Mainland of China.

Questionnaire replies from sampled exporters/producers must reach the Commission within 37 days from the date of the notification of their inclusion in the sample.

All interested parties who did not co-operate in the investigation leading to the imposition of the measures subject to the present review should request a copy of the questionnaire within 15 days from 28 December 2006.

All interested parties may present their views in writing, submit questionnaire replies and provide supporting evidence to the Commission within 40 days from 28 December 2006, unless otherwise specified. They may also apply to be heard by the Commission within the same 40-day time limit.

Background

  1. Definitive anti-dumping duty on imports of certain finished polyester filament fabrics originating in the Mainland of China has been imposed since 17 September 2005 at a rate of 56.2% of the net, free-at-Community-frontier price before duty (except for 45 companies with individual duty rates ranging from 14.1% to 56.2%).
