European Union (EU)* : Initiation of a Partial Interim Review of the Anti-dumping Measures on Imports of Tartaric Acid Originating in the Mainland of China

Further to Commercial Information Circular No. 40/2006 of 27 January 2006, the European Commission (the Commission) has published a notice to initiate a partial interim review of the anti-dumping measures imposed on imports of tartaric acid originating in the Mainland of China. Grounds for the Review

  1. On the basis of a request lodged by CU Chemie Uetikon GmbH (the applicant), the Commission has initiated the partial interim review on 17 March 2007. The review is limited to the examination of the product scope as regards the exclusion of the 'D' grade of tartaric acid.
     
  2. The applicant has provided prima facie evidence indicating that certain types of tartaric acid should not be subject to the anti-dumping measures. It appears that the so-called 'D' grade is a distinct product from other types of tartaric acid, due to its specific molecular structure, which in turn determines specific chemical characteristics not shared by other types of tartaric acid. These characteristics imply different uses for 'D' grade, for which there is no interchangeability with other types of tartaric acid. It is therefore appropriate to review whether 'D' grade should be regarded as falling within the scope of tartaric acid.

Review Procedures

  1. Salient points of the partial interim review are set out below –
(a) Date of Publication of the Notice of Initiation : 17 March 2007
(b) Product Coverage : Tartaric acid, currently classifiable within CN code 2918 12 00 (the CN code is given only for information).
(c) Procedures : The investigation will assess the need for the amendment of the scope of the existing anti-dumping measures.

In order to obtain information for the investigation, the Commission will contact the Community industry, importers, users, other known producers in the Community and exporting producers in the Mainland of China.

All interested parties may make their views known in writing and provide information and supporting evidence to the Commission, and also apply to be heard by the Commission within 40 days from 17 March 2007, unless otherwise specified.

(d)Investigation Schedule : Investigation will be concluded within 15 months from 17 March 2007.

Background

  1. Definitive anti-dumping duty on imports of tartaric acid originating in the Mainland of China has been imposed since 28 January 2006. The rate of duty is 34.9% of the net, free-at-Community-frontier price before duty (except for three companies with individual duty rates ranging from 0% to 10.1%).
