European Union (EU)* : Termination of the Anti-absorption Reinvestigation Concerning Imports of Hand Pallet Trucks and Their Essential Parts Originating in the Mainland of China

Further to Commercial Information Circular No. 123/2006 of 31 March 2006, the European Commission (the Commission) has published a decision to terminate the anti-absorption reinvestigation concerning imports of hand pallet trucks and their essential parts originating in the Mainland of China. DETAILS

  1. On the basis of a request lodged by four major Community producers representing more than 70% of the total Community production of hand pallet trucks and essential parts, the Commission initiated a reinvestigation on 31 March 2006. The purpose of the reinvestigation was to establish whether or not since the imposition of the original anti-dumping measures (i) export prices had decreased or (ii) there had been no or insuffiicient movement in resale prices or subsequent selling prices in the Community of the product concerned.
  2. The reinvestigation found that there was no decrease in the average export price of the product concerned, and that resale prices in the Community at the level of importers and / or distributors had increased by amounts exceeding the anti-dumping duty. Though representative data with regard to subsequent selling prices were not available, the Commission considered it not unreasonable to conclude that the subsequent selling prices would also have shown sufficient movement given that resale prices of importers to unrelated customers were found to have shown sufficient movement since the imposition of anti-dumping measures. It was therefore concluded that absorption of the anti-dumping measures could not be established since neither a decrease in export prices nor an insufficient movement in resale prices or subsequent selling prices for the product concerned was found. Consequently, the Commission decided to terminate the reinvestigation.

BACKGROUND

  1. Definitive anti-dumping duty on imports of hand pallet trucks and their essential parts originating in the Mainland of China has been imposed since 22 July 2005 at a rate of 46.7% of the net, free-at-Community-frontier price before duty (except for four companies with individual duty rates ranging from 7.6% to 39.9%).
