European Union (EU) * : Extension of the Definitive Anti-dumping Duty Imposed
on Imports of Coumarin Originating in the Mainland of China to Imports of the
Same Products Consigned from Indonesia or Malaysia, Whether Declared as Originating in Indonesia or Malaysia or Not

Further to Commercial Information Circular No. 119/2006 of 29 March 2006, the Council of the EU (the Council) has published a regulation to extend the definitive anti-dumping duty imposed on imports of coumarin originating in the Mainland of China to imports of the same products consigned from Indonesia or Malaysia, whether declared as originating in Indonesia or Malaysia or not. DETAILS

  1. The European Commission (the Commission) published a regulation on 29 March 2006 to initiate an investigation into the alleged circumvention of anti-dumping measures imposed on imports of coumarin originating in the Mainland of China by imports of the same products consigned from Indonesia or Malaysia.
  1. Based on the findings of the circumvention investigation, the Council has decided that with effect from 11 November 2006, the definitive anti-dumping duty imposed on imports of coumarin originating in the Mainland of China, falling within CN code ex 2932 2100, is extended to imports of the same products consigned from Indonesia or Malaysia, whether declared as originating in Indonesia or Malaysia or not (TARIC code 2932 21 00 16).
  1. The Council may decide to exempt imports which do not circumvent the anti-dumping measures from the anti-dumping duty extended by this regulation. Requests for exemption should be made in writing in one of the official languages of the EU and must be signed by a person authorised to represent the applicant. The request must be sent to the following address :

  1. With the extension of the anti-dumping duty, the registration requirement of imports of coumarin consigned from Indonesia or Malaysia, whether declared as originating in Indonesia or Malaysia or not, falling within CN code ex 2932 21 00 (TARIC code 2932 21 00 16), is discontinued.

BACKGROUND

  1. Definitive anti-dumping duties on coumarin originating in the Mainland of China have been imposed since 5 April 1996 and extended for another five years starting from 10 May 2002 subsequent to an expiry review. The current duty in force is EUR 3,479 per tonne. Furthermore, based on the findings of a circumvention investigation, the Council of the EU has extended, with effect from 1 January 2005, the definitive anti-dumping duty imposed on imports of coumarin originating in the Mainland of China to imports of the same products consigned from India or Thailand, whether declared as originating in India or Thailand or not (TARIC codes 2932 21 00 11 and 2932 21 00 15).
