European Union (EU)* : Termination of the Anti-dumping Proceeding Concerning Imports of Recordable Compact Discs Originating in the Mainland of China

Further to Commercial Information Circular No. 171/2006 of 6 May 2006, the European Commission (the Commission) published a decision on 4 November 2006 to terminate the anti-dumping (AD) proceeding concerning imports of recordable compact discs (CD-Rs) originating in the Mainland of China. A copy of the decision is at Annex (pdf format) for reference.

On 6 August 2005, the Commission initiated AD proceeding against imports of CD-Rs originating in, inter alia, the Mainland of China, on the basis of a complaint lodged by the Committee of European CD-R and DVD+/–R Manufacturers. By the deadline of 5 May 2006 for imposition of provisional AD duty, the Commission decided against imposing any AD duty on Mainland-origin CD-Rs before conclusion of the investigation.

Despite claiming to have found that imports from the Mainland of China have undercut the Community industry's sales price by 43.9% during the investigation period, and that dumped imports from, inter alia, the Mainland of China have had a direct effect on the injurious situation of the Community industry, the Commission considered that imposition of AD measures in this particular case would have substantial negative effects on importers, distributors, retailers and consumers of the product concerned but would unlikely benefit the Community industry significantly. The Commission therefore decided that compelling reasons exist on Community interest grounds not to adopt AD measures and that the AD proceeding concerning Mainland-origin CD-Rs should be terminated.
