Union (EU)* : Termination of the Anti-dumping Proceeding
Concerning Imports of Recordable Compact Discs Originating in Hong Kong
Further to Commercial
Information Circular No. 174/2006 of 6 May 2006, the European Commission
(the Commission) published a decision on 4 November 2006 to terminate
the anti-dumping (AD) proceeding concerning imports of recordable compact
discs (CD-Rs) originating in Hong Kong. A copy of the decision is at
Annex (pdf format) for reference.
DETAILS
- On 6 August
2005, the Commission initiated AD proceeding against imports of CD-Rs
originating in, inter alia, Hong Kong, on the basis of a complaint
lodged by the Committee of European CD-R and DVD+/-R Manufacturers.
By the deadline of 5 May 2006 for imposition of provisional AD duty,
the Commission decided against imposing any AD duty on Hong Kong-origin
CD-Rs before conclusion of the investigation.
- Despite claiming
to have found that imports from Hong Kong have undercut the Community
industry's sales price by 69.7% during the investigation period, and
that dumped imports from, inter alia, Hong Kong have had a direct
effect on the injurious situation of the Community industry, the Commission
considered that imposition of AD measures in this particular case
would have substantial negative effects on importers, distributors,
retailers and consumers of the product concerned but would unlikely
benefit the Community industry significantly. The Commission therefore
decided that compelling reasons exist on Community interest grounds
not to adopt AD measures and that the AD proceeding concerning Hong
Kong-origin CD-Rs should be terminated.
