European Union (EU)* : Suspending the Anti-dumping Measures on Imports of Ferro Molybdenum Originating in the Mainland of China

Further to Commercial Information Circular No. 198/2006 of 24 May 2006, the European Commission (the Commission) has published a decision on 24 October 2006 to suspend the definitive anti-dumping measures on imports of ferro molybdenum originating in the Mainland of China. A copy of the decision is at Annex ( pdf format) for reference.

DETAILS

  1. The Commission received information from Eurofer (on behalf of a number of users of the product concerned) on a change of market conditions which occurred after the original investigation period of the anti-dumping proceeding and which might justify the suspension of the anti-dumping measures currently in force. Such changes included substantial drop in import penetration of the product concerned from the Mainland of China, increase in market price in the Community and improvements in the situation of the Community industry in terms of sales, production volumes and profits. The Commission considered that the injury linked to the imports of the product concerned originating in the Mainland of China was unlikely to resume as a result of suspension of the anti-dumping measures, and decided to suspend the measures for 9 months starting from 25 October 2006.
  2. Should a situation arise at any time in which increased volumes at dumped prices of the product concerned from the Mainland of China resume and consequently cause injury to the Community industry, the Commission will reinstate the anti-dumping duty by repealing the present suspension.

BACKGROUND

  1. Definitive anti-dumping duty on imports of ferro molybdenum originating in the Mainland of China has been imposed since 7 February 2002 at a rate of 22.5% of the net, free-at-Community-frontier price before duty.
  2. The Commission published a notice concerning the impending expiry of the anti-dumping measures on 24 May 2006. Unless a review is initiated in accordance with the procedures set out in the notice, the anti-dumping duty will expire on 7 February 2007.
