Commercial Information Circular No. 307/2006

European Union (EU) * : Temporary Ban on Novelty Lighters and Lighters without Child-resistant Device

The European Commission (the Commission) adopted a Decision to impose temporary ban on novelty lighters and lighters without child-resistant device on the market. A copy (pdf format) of the Commission Decision is attached to this circular for reference. 

DETAILS

  1. In view of the inherently hazardous nature of lighters and the seriousness of the risk posed to children's safety, the Commission adopted a Decision to take the following temporary measures to deal with the risk posed by non-child-resistant lighters: 

  1. Only lighters which are child-resistant can be placed on the market;

  2. producers are requested to keep and provide on request a report of child-resistance test for the model of lighters placed on the market; and

  3. all novelty lighters shall be prohibited.

  1. Refillable lighters for which the producers can provide documentation ensuring a continual expected safe use over a lifetime of at least five years are exempted.

  2. These measures are applicable until 10 months from the date of notification of the Decision and may be prolonged by the Commission if deemed necessary.
