European Union (EU)* : Initiation of a Partial Interim Review of the Anti-dumping Measures on Imports of Bicycles Originating in the Mainland of China

Further to Commercial Information Circular No. 479/2005 of 24 November 2005, the European Commission (the Commission) has published a notice to initiate a partial interim review of the anti-dumping measures imposed on imports of bicycles originating in the mainland of China. Grounds for the Review

  2. The Commission has decided on its own initiative to initiate a partial interim review on 10 January 2006. The review is limited in scope to dumping aspects concerning Giant China Co., Ltd. (the company), an exporter from the mainland of China. There is sufficient evidence available to the Commission that the circumstances on the basis of which the existing measures were established have changed and that these changes are of a lasting nature. The information at the Commission's disposal indicates that the company fulfils the criteria to grant for market economy status. Furthermore, a comparison of normal value based on the company's own cost/domestic prices and its export prices would lead to a reduction of dumping significantly below the level of the current anti-dumping measures.

Review Procedure

  1. Salient points of the partial interim review are set out below-
(a) Date of Publication of the Notice of Initiation : 10 January 2006
(b) Product Coverage : Bicycles and other cycles (including delivery tricycles, but excluding unicycles), not motorised, currently classifiable within CN codes ex 8712 00 10, 8712 00 30 and ex 8712 00 80 (these CN codes are given for information only).
(c) Procedures :
In order to obtain information for the investigation, the Commission will send questionnaires as well as market economy status claim forms to the company and the authorities of the mainland of China.

All interested parties may make their views known in writing (including submitting questionnaire replies) and provide supporting evidence to the Commission, and also apply to be heard by the Commission within 40 days from 10 January 2006, unless otherwise specified.

The company's duly substantiated claims for market economy status must reach the Commission within 21 days from 10 January 2006.

Background

  1. Definitive anti-dumping duty on imports of bicycles originating in the mainland of China has been imposed since 10 September 1993 at a rate of 30.6% of the net, free-at-Community-frontier price before duty and extended for another five years since 15 July 2000 consequent to an expiry review. Subsequent to an interim review, the subject anti-dumping duties have been increased to 48.5% and imposed for a new five-year term starting from 15 July 2005.
