European Union (EU)* : Non-imposition of Provisional Anti-dumping Duty on Imports of Recordable Digital Versatile Discs Originating in the Mainland of China

Further to Commercial Information Circular No. 316/2005 of 9 August 2005, the European Union has not imposed provisional anti-dumping (AD) duty on imports of recordable digital versatile discs (DVD+/-Rs) originating in the mainland of China. 

DETAILS

  1. On 6 August 2005, the European Commission (Commission) initiated AD proceedings against imports of DVD+/-Rs originating in, inter alia, the mainland of China, on the basis of a complaint lodged by the Committee of European CD-R and DVD+/-R Manufacturers. 

  2. According to the EU's AD Regulation, provisional AD duty on products under investigation may be imposed no later than 9 months from the date of initiation. For the AD investigation against DVD+/-Rs originating in the mainland of China, the deadline for so doing expired on 5 May 2006. Accordingly, the Commission will not impose any AD duty on Mainland-origin DVD+/-Rs before the conclusion of the investigation. 

  3. The Commission is required by the same Regulation to complete the investigation within 15 months from the date of initiation (i.e., by 5 November 2006) and, based on its proposal after consultation with the AD Advisory Committee, the Council of the European Union will decide whether definitive AD duty will be imposed on Mainland-origin DVD+/-Rs.

  4. Companies which have cooperated with the Commission in the investigation will be notified individually by the Commission of the development.
