European Union (EU)* : Initiation of a Reinvestigation of the Anti-dumping Measures on Imports of Hand Pallet Trucks and Their Essential Parts Originating in the Mainland of China

Further to Commercial Information Circular No. 274/2005 of 23 July 2005, the European Commission (the Commission) has published a notice to initiate a reinvestigation of the anti-dumping measures imposed on imports of hand pallet trucks and their essential parts originating in the mainland of China. DETAILS

Grounds for the Reinvestigation

  1. On the basis of a request lodged by four Community producers representing more than 70% of the total Community production of hand pallet trucks and their essential parts, the Commission initiated a reinvestigation on 31 March 2006 to ascertain whether the existing anti-dumping measures have had effects on the export prices, resale prices or subsequent selling prices in the Community.

Reinvestigation Procedure

  1. Salient points of the reinvestigation are set out below-
(a) Date of Publication of the Notice of Initiation : 31 March 2006
(b) Product Coverage : Hand pallet trucks and their essential parts, i.e. chassis and hydraulics, currently classifiable within CN codes ex 8427 9000 and ex 8431 2000 (these CN codes are given for information only).
(c) Procedures :

In order to obtain information for the reinvestigation, the Commission will send questionnaires to the parties named in the request or which co-operated in the investigation leading to the measures subject to the present reinvestigation, in particular to the exporters/producers of the mainland of China, any association of exporters/producers, importers, any association of importers, the users and the authorities of the mainland of China.

All interested parties who did not co-operate in the investigation leading to the measures subject to the present reinvestigation should request a copy of the questionnaire within 15 days from 31 March 2006.

All interested parties may make their views known in writing (including submitting questionnaire replies) and provide supporting evidence to the Commission, and also apply to be heard by the Commission within 40 days from 31 March 2006, unless otherwise specified.

Background

  1. Definitive anti-dumping duty on imports of hand pallet trucks and their essential parts originating in the mainland of China has been imposed since 22 July 2005 at a rate of 46.7% of the net, free-at-Community-frontier price before duty (except for four companies with individual duty rates ranging from 7.6% to 39.9%).
