European Union (EU)* : Initiation of an Investigation Concerning the Possible Circumvention of Anti-dumping Measures Imposed on Imports of Coumarin Originating in the Mainland of China by Imports of the Same Products Consigned from Indonesia and Malaysia, Whether Declared as Originating in Indonesia and Malaysia or Not
Further to Commercial Information Circular No. 12/2005 of 7 January 2005, the European Commission (the Commission) has published a regulation to initiate an investigation into the possible circumvention of anti-dumping measures imposed on imports of coumarin originating in the mainland of China by imports of the same products consigned from Indonesia and Malaysia, whether declared as originating in Indonesia and Malaysia or not. The Regulation also requires imports of coumarin consigned from Indonesia and Malaysia, whether declared as originating in Indonesia and Malaysia or not, to be subject to registration. A copy of the Regulation is at Annex (pdf format) for reference. Salient points are set out below -

In order to obtain necessary information for the investigation, the Commission will send questionnaires to exporters/producers and the associations of exporters/producers in Indonesia, Malaysia and the mainland of China, importers and the associations of importers in the Community which co-operated in the investigation that led to the existing measures or which is listed in the request, and to the authorities of the mainland of China, Indonesia and Malaysia.
Interested parties should request a copy of the questionnaire from the Commission within 15 days from 29 March 2006.
All interested parties may make their views known in writing (including submitting questionnaire replies) and apply to be heard by the Commission within 40 days from 29 March 2006, unless otherwise specified.

With effect from 30 March 2006, imports of coumarin, classifiable under CN codes ex 2932 2100 (TARIC code 2932 21 00 16), consigned from Indonesia and Malaysia, whether declared as originating in Indonesia and Malaysia or not, have been subject to registration by the EU's customs authorities. The registration shall expire nine months from 30 March 2006.
Should the investigation result in findings of circumvention, anti-dumping duties imposed on imports of coumarin originating in the mainland of China can be levied retrospectively to the imports of the same products consigned from Indonesia and Malaysia with effect from the date of registration of such imports. |
| (e) Exemption from Registration of Imports or Measures |

Imports of the products concerned may be exempted from registration or measures if the importation does not constitute circumvention.
Producers wishing to obtain an exemption from registration of imports or measures should submit a request duly supported by evidence within 40 days from 29 March 2006, unless otherwise specified. |
BACKGROUND
- Definitive anti-dumping duties on coumarin originating in the mainland of China have been imposed since 5 April 1996 and extended for another five years starting from 10 May 2002 subsequent to an en expiry review. The current duty in force is EUR3,479 per tonne. Furthermore, based on the findings of a circumvention investigation, the Council of the EU has extended, with effect from 1 January 2005, the definitive anti-dumping duty imposed on imports of coumarin originating in the mainland of China to imports of the same products consigned from India or Thailand, whether declared as originating in India or Thailand or not (TARIC codes 2932 21 00 11 and 2932 21 00 15).
- On 13 February 2006, the European Chemical Industry Council on behalf of the sole producer representing 100% of the Community production of coumarin complained that the anti-dumping measures on imports of coumarin originating in the mainland of China were being circumvented by means of transhipment via Indonesia and Malaysia of the products concerned. On the basis of the complaint, the Commission initiated the present circumvention investigation.
