European Union (EU)* : Termination of the Investigation Concerning the Possible Circumvention of the Anti-dumping Measures on Imports of Certain Zinc Oxides Originating in the Mainland of China by Imports of the Same Products Consigned from Kazakhstan, Whether Declared as Originating in Kazakhstan or Not

Further to Commercial Information Circular No. 310/2005 of 6 August 2005, the European Commission (the Commission) has published a regulation to terminate the investigation concerning the possible circumvention of anti-dumping measures imposed on imports of certain zinc oxides originating in the mainland of China by imports of the same products consigned from Kazakhstan, whether declared as originating in Kazakhstan or not. The Regulation also terminates the required registration on imports of certain zinc oxides consigned from Kazakhstan, whether declared as originating in Kazakhstan or not. DETAILS

  1. On 5 August 2005, the Commission initiated a circumvention investigation at the request of Eurometaux who provided prima facie evidence showing that the anti-dumping measures on imports of certain zinc oxides originating in the mainland of China were being circumvented by means of transhipment via Kazakhstan.
  1. The investigation revealed that the sole exporter of certain zinc oxides in Kazakhstan had to be considered as a genuine producer, and thus transhipment of certain zinc oxides via Kazakhstan had not taken place. In light of such findings, the Commission decided that the circumvention investigation should be terminated with effect from 23 March 2006. The required registration on imports of certain zinc oxides consigned from Kazakhstan, whether declared as originating in Kazakhstan or not, should also be terminated on the same date.

BACKGROUND

  1. Definitive anti-dumping duty on imports of certain zinc oxides originating in the mainland of China has been imposed since 6 March 2002. The rate of duty is 28.0% of the net, free-at-Community-frontier price before duty.
