European Union (EU)* : Initiation of a Partial Interim Review of the Anti-dumping Measures on Imports of Bicycles Originating in the Mainland of China

Further to Commercial Information Circular No. 265/2004 of 29 October 2004, the European Commission (the Commission) has published a notice to initiate a partial interim review of the anti-dumping measures imposed on imports of bicycles originating in the mainland of China. A copy of the notice is at Annex (pdf format) for reference.

DETAILS

Grounds for the Review

  1. On the basis of a request lodged by Giant China Co., Ltd. (the applicant) who is an exporter from the mainland of China, the Commission initiated a partial interim review on 19 February 2005. The applicant alleged that the circumstances with regard to market economy status have changed significantly and that the anti-dumping measures would be significantly different if they were based on information including exports to the ten new Member States of the EU*. The applicant also provided evidence showing that a comparison of normal value based on its own cost/domestic prices and its export prices to the enlarged EU would lead to a reduction of dumping significantly below the level of the current anti-dumping measures.
  1. In addition, the Commission invites other mainland producers to come forward immediately and indicate whether they also wish to have a new dumping margin calculated based on exports to the enlarged EU. The Commission will publish its decision on whether to accede to such requests in the Official Journal of the EU in due course.

Review Procedure

  1. Salient points of the partial interim review are set out below-
(a) Date of Publication of the Notice of Initiation  : 19 February 2005
(b) Product Coverage : Bicycles and other cycles (including delivery tricycles), not motorised, currently classifiable within CN codes 8712 00 10, 8712 00 30 and 8712 00 80 (these CN codes are given for information only).
(c) Procedures : In order to obtain information for the investigation, the Commission will send questionnaires as well as market economy status claim forms to the applicant and the authorities of the mainland of China.

All interested parties may make their views known in writing (including submitting questionnaire replies) and provide supporting evidence to the Commission, and also apply to be heard by the Commission within 40 days from 19 February 2005, unless otherwise specified.

The applicant's duly substantiated claims for market economy status must reach the Commission within 21 days from 19 February 2005.

Background

  1. Definitive anti-dumping duty on imports of bicycles originating in the mainland of China has been imposed since 10 September 1993, and extended for another five years starting from 15 July 2000 subsequent to an expiry review. The rate of duty is 30.6% of the net, free-at-Community-frontier price before duty.
