European Union (EU)* : Initiation of an Expiry Review of the Anti-dumping Measures on Imports of Dead-burned (Sintered) Magnesia Originating in the Mainland of China

Further to Commercial Information Circular No. 212/2004 of 2 September 2004, the European Commission (the Commission) has published a notice to initiate an expiry review of the anti-dumping measures imposed on imports of dead-burned (sintered) magnesia originating in the mainland of China. A copy of the notice is at Annex (pdf format) for reference.

DETAILS

Grounds for the Review

  1. On the basis of a request lodged by Eurométaux (the applicant), the Commission initiated the expiry review on 15 February 2005. The applicant claimed that there would be continuation or recurrence of dumping and injury to the Community industry with the expiry of the anti-dumping measures.

Review Procedure

  1. Salient points of the expiry review are set out below-
(a) Date of Publication of the Notice  :  15 February 2005
(b) Product Coverage : Dead-burned (sintered) magnesia, classifiable within CN code 2519 90 30 (this CN code is given for information only).
(c) Procedures  :

In view of the apparent large number of parties involved in the proceedings, the Commission may apply sampling technique. Exporters/producers, or representatives acting on their behalf should, within 15 days from 15 February 2005, make themselves known to the Commission and provide information requested in paragraph 5.1 (a) (i) of the notice in question, including contact details, turnover, activities of their company/companies, and indication of agreement for being included in the sample which implies replying to a questionnaire and accepting an on-the-spot investigation.

In order to obtain necessary information for the investigation, the Commission will send questionnaires to the Community industry, any association of producers in the Community, sampled exporters/producers in the mainland of China, any association of exporters/producers, sampled importers, any association of importers named in the request or which co-operated in the investigation leading to the measures subject to the present review, and the authorities of the mainland of China.

Exporters/producers sampled must reply to the questionnaires within 37 days from the date of the notification of their inclusion in the sample.

Interested parties who did not co-operate in the investigation leading to the measures subject to the present review should request a copy of the questionnaire within 15 days from 15 February 2005.

All interested parties may make their views known in writing (including submitting questionnaire replies) and provide supporting evidence to the Commission within 40 days from 15 February 2005, unless otherwise specified. They may also apply to be heard by the Commission within 40 days from 15 February 2005.

Background

  1. Definitive anti-dumping duty on imports of dead-burned (sintered) magnesia originating in the mainland of China has been imposed since 12 December 1993, and extended for another five years starting from 19 February 2000 subsequent to an expiry review. Following an interim review, the rate of duty has been revised since 12 June 2003 to the following :

    1. the difference between the minimum import price of EUR 120 per tonne and the net, free-at-Community-frontier price before duty in all cases where the latter is less than the minimum import price, and established on the basis of an invoice issued by an exporter located in the mainland of China directly to an unrelated party in the Community;

    2. zero, if the net, free-at-Community-frontier price before duty is established on the basis of an invoice issued by an exporter located in the mainland of China directly to an unrelated party in the Community and equal to or higher than the minimum import price of EUR 120 per tonne; and

    3. an ad valorem duty of 63.3% in all other cases not falling under (a) and (b) above.
