European Union (EU)* : Result of "New Exporter" Review of the Anti-dumping Measures on Imports of Polyethylene Terephthalate (PET) Originating in, inter alia, the Mainland of China

Further to Commercial Information Circular No. 114/2005 of 6 April 2005, the Council of the EU has published a regulation announcing its decision to re-impose a definitive anti-dumping duty on imports of polyethylene terephthalate originating in the mainland of China from a mainland company, Jiangyin Chengsheng New Packing Material Co., Ltd, consequent to a "new exporter" review. With the imposition of the anti-dumping duty, the registration of imports of the subject product produced by the company is discontinued. A copy of the regulation is at Annex (pdf format) for reference. Salient points are set out below-

(a) Product : Polyethylene terephthalate (PET) having a viscosity number of 78 ml/g or higher, according to the ISO Standard 1628–5, classified under CN code 3907 60 20.
(b) Rate of Duty : An individual duty rate of EUR 45 per tonne is applicable to imports of the product concerned from Jiangyin Chengsheng New Packing Material Co., Ltd.
(c) Effective Date : 29 December 2005(The duty imposed shall be levied retroactively on imports of the product concerned which have been registered since 3 April 2005.)

BACKGROUND

Definitive anti-dumping duty on imports of polyethylene terephthalate (PET) originating in, inter alia, the mainland of China has been imposed since 20 August 2004 at a rate of EUR 184 per tonne (except for eight companies with individual duty rates ranging from EUR 0 to EUR 184 per tonne). 
     
  3. A mainland company, Jiangyi Chengsheng New Packaging Material Co., Ltd. (the applicant) requested a "new exporter" review. The applicant claimed that it had started exporting the product concerned to the Community only after the original investigation period (1 April 2002 to 31 March 2003) on which the anti-dumping measures were based, and that it was not related to the mainland exporting producers which are subject to the anti-dumping measures. The European Commission therefore initiated the "new exporter" review on 3 April 2005. The anti-dumping duty in force with regard to the imports concerned supplied by the applicant was therefore repealed. At the same time, such imports were subject to registration for nine months from 3 April 2005, so that anti-dumping duties can be levied retroactively should the review result in a determination of dumping in respect of the applicant.
