European Union (EU)* : Termination of the Partial Interim Review of the Anti-dumping Measures on Imports of Bicycles Originating in the Mainland of China

Further to Commercial Information Circular No. 64/2005 of 25 February 2005, the Council of the EU (the Council) has published a regulation to terminate the partial interim review without amending the anti-dumping measures imposed on imports of bicycles originating in the mainland of China. A copy of the regulation is at Annex (pdf format) for reference.

DETAILS

  1. On 19 February 2005, the European Commission initiated a partial interim review at the request of Giant China Co., Ltd. (the applicant) from the mainland of China who claimed that it now fulfilled the requirements to be granted market economy status (MES). The applicant also provided evidence showing that a comparison of normal value based on its own cost/domestic prices and its export prices to the enlarged EU would lead to a dumping margin significantly below the level of the current measure. Accordingly, the applicant alleged that the continued imposition of the AD measure at its current level was no longer necessary.

  2. The investigation revealed that the applicant did not meet the criteria for MES or individual treatment (IT). It was considered that in the case of the applicant, the circumstances with regard to dumping have not changed significantly compared to the situation prevailing during the investigation period used in the investigation which led to the current measures. In light of such findings, the Council decided that the partial interim review of the anti-dumping measures imposed on imports of bicycles originating in the mainland of China should be terminated with effect from 20 November 2005.

BACKGROUND

  1. Definitive anti-dumping duties on imports of bicycles originating in the mainland of China have been imposed since 10 September 1993 at a rate of 30.6% of the net, free-at-Community-frontier price before duty and extended for another five years since 15 July 2000 consequent to an expiry review. Subsequent to an interim review, the subject anti-dumping duties have been increased to 48.5% and imposed for a new five-year term starting from 15 July 2005.
