Commercial Information Circular No. 274/2005

European Union (EU)* : Imposition of a Definitive Anti-dumping Duty on Imports of Hand Pallet Trucks and Their Essential Parts Originating in the Mainland of China

Further to Commercial Information Circular No. 46/2005 of 5 February 2005, the Council of the EU has published a regulation to impose a definitive anti-dumping duty on imports of hand pallet trucks and their essential parts originating in the mainland of China. A copy of the regulation is at Annex (pdf format) for reference. Salient points are set out below-

(a) Product : Hand pallet trucks and their essential parts, i.e. chassis and hydraulics, falling within CN codes ex 8427 90 00 and e 8431 20 00 (TARIC codes 8427 90 00 10 and 8431 20 00 10).
(b) Rate of Duty : 46.7% of the net, free-at-Community-frontier price before duty (except for four companies with individual duty rates ranging from 7.6% to 39.9%).
(c) Effective Date : 22 July 2005
(d) Duration : Five years
(e) Collection of Provisional Duty : Amounts secured by way of provisional anti-dumping duty imposed since 29 January 2005 will be definitively collected at the rate of the definitive anti-dumping duty. The amounts secured in excess of the amount of the definitive anti-dumping duty will be released. Where the definitive duty is higher than the provisional duty, only the amounts secured at the level of the provisional duty will be definitively collected.
