European Union (EU)* : Result of Expiry Review of the Anti-dumping Measures on Imports of Magnesium Oxide Originating in the Mainland of China
Further to Commercial Information Circular No. 135/2004 of 21 May 2004, the Council of the EU has published a regulation announcing the decision to maintain the anti-dumping duty imposed on imports of magnesium oxide originating in the mainland of China consequent to an expiry review. A copy of the regulation is at Annex (pdf format) for reference. Salient points are set out below-

(i) the difference between the minimum import price of EUR 112 per tonne and the net, free-at-Community-frontier price before duty in all cases where the latter is less than the minimum import price, and established on the basis of an invoice issued by an exporter located in the mainland of China directly to an unrelated party in the Community;
(ii) zero, if the net, free-at-Community-frontier price before duty is established on the basis of an invoice issued by an exporter located in the mainland of China directly to an unrelated party in the Community and equal to or higher than the minimum import price of EUR 112 per tonne; and
(iii) an ad valorem duty of 27.1% in all other cases not falling under (a) and (b) above. |

BACKGROUND
- Definitive anti-dumping duty on imports of magnesium oxide originating in the mainland of China has been imposed since 18 June 1993, and extended for another five years starting from 26 June 1999 subsequent to an expiry review. Following an interim review, the rate of duty has been revised since 12 June 2003 by maintaining a minimum price subject to specific conditions and imposing an ad valorem duty of 27.1% in all other cases.
- On 9 March 2004, the Community producers requested an expiry review alleging that there would be a continuation or recurrence of dumping and injury to the Community industry with the expiry of the anti-dumping duty. The Commission therefore initiated an expiry review on 18 May 2004. The anti-dumping duty remained in force pending the outcome of the expiry review.
