European Union (EU)* : Result of "New Exporter" Review of the Anti-dumping Measures on Imports of Certain Electronic Weighing Scales Originating in, inter alia, the Mainland of China

Further to Commercial Information Circular No. 199/2004 of 7 August 2004, the Council of the EU has published a regulation announcing its decision to re-impose a definitive anti-dumping duty on imports of certain electronic weighing scales originating in the mainland of China from two related mainland companies, Shanghai Excell M&E Enterprise Co., Ltd. and Shanghai Adeptech Precision Co., Ltd., consequent to a "new exporter" review. With the imposition of the anti-dumping duty, the registration of imports of the subject product produced by these two companies is discontinued. A copy of the regulation is at Annex (pdf format) for reference. Salient points are set out below-

(a) Product : Electronic weighing scales for use in the retail trade, having a maximum weighing capacity not exceeding 30kg, which incorporate a digital display of the weight, unit price and price to be paid (whether or not including a means of printing this data), normally declared within CN code ex 8423 81 50 (TARIC code 8423 81 50 10).
(b) Rate of Duty : An individual duty rate of 52.6% of the net, free-at-Community-frontier price before duty is applicable to imports of the product concerned from two related mainland companies, Shanghai Excell M&E Enterprise Co., Ltd. and Shanghai Adeptech Precision Co., Ltd.
(c) Effective Date : 4 May 2005(The duty imposed shall be levied retroactively on imports of the product concerned which have been registered since 4 August 2004.)

BACKGROUND

  1. Definitive anti-dumping duty on imports of certain electronic weighing scales originating in, inter alia, the mainland of China has been imposed since 1 December 2000 at a rate of 30.7% of the net, free-at-Community-frontier price before duty (except for three companies with individual duty rates ranging from 0% to 12.8%).
     
  2. Two related mainland companies, Shanghai Excell M&E Enterprise Co., Ltd. and Shanghai Adeptech Precision Co., Ltd. (the applicant) requested a "new exporter" review. The applicant claimed that it had started exporting the product concerned to the Community only after the original investigation period (1 September 1998 to 31 August 1999) on which the anti-dumping measures were based, and that it was not related to the mainland exporting producers which are subject to the anti-dumping measures. The European Commission therefore initiated the "new exporter" review on 4 August 2004. The anti-dumping duty in force with regard to the imports concerned supplied by the applicant was therefore repealed. At the same time, such imports were subject to registration for nine months from 4 August 2004, so that anti-dumping duties can be levied retroactively should the review result in a determination of dumping in respect of the applicant.
