European Union (EU) * : Extension of the Definitive Anti-dumping Duty Imposed on Imports of Coumarin Originating in the Mainland of China to Imports of the Same Products Consigned from India or Thailand, Whether Declared as Originating in India or Thailand or Not
Further to Commercial Information Circular No. 93/2004 of 17 April 2004, the Council of the EU (the Council) has published a regulation to extend the definitive anti-dumping duty imposed on imports of coumarin originating in the mainland of China to imports of the same products consigned from India or Thailand, whether declared as originating in India or Thailand or not. A copy of the regulation is attached (pdf format) for reference.
DETAILS
- The European Commission (the Commission) published a regulation on 8 April 2004 to initiate an investigation into the alleged circumvention of anti-dumping measures imposed on imports of coumarin originating in the mainland of China by imports of the same products consigned from India or Thailand.
- Based on the findings of the circumvention investigation, the Council has decided that with effect from 1 January 2005, the definitive anti-dumping duty imposed on imports of coumarin originating in the mainland of China, falling within CN codes ex 2932 2100, is extended to imports of the same products consigned from India or Thailand, whether declared as originating in India or Thailand or not (TARIC codes 2932 21 00 11 and 2932 21 00 15 respectively).
- Imports shall be exempted from the extended anti-dumping duty provided that they are produced by companies from which undertakings are accepted by the Commission. Requests for exemption should be made in writing in one of the official languages of the Community and must be signed by a person authorised to represent the applicant. The request must be sent to the following address:

- With the extension of the anti-dumping duty, the registration requirement of imports of coumarin consigned from India or Thailand, whether declared as originating in India or Thailand or not, falling within CN codes ex 2932 21 00 (TARIC codes 2932 21 00 11 and 2932 21 00 15), is discontinued.
- Definitive anti-dumping duty on imports of coumarin originating in the mainland of China has been imposed since 5 April 1996 and extended for another five years starting from 10 May 2002 subsequent to an expiry review. The rate of duty is EUR3,479 per tonne.
