Commercial Information Circular No. 100/2005

European Union (EU)* : Imposition of Provisional Anti-dumping Duty on Imports of Certain Finished Polyester Filament Apparel Fabrics Originating in the Mainland of China

Further to the Commercial Information Circular No. 158/2004 dated 21 June 2004, the European Commission (the Commission) has published a regulation to impose a provisional anti-dumping duty on imports of certain finished polyester filament apparel fabrics originating in the Mainland of China. A copy of the regulation is at Annex (pdf format) for reference. Salient points are set out below:

(a) Product : Woven fabrics of synthetic filament yarn containing 85% or more by weight of textured and/or non-textured polyester filament, dyed or printed, falling within CN codes 5407 52 00, 5407 54 00, 5407 61 30, 5407 61 90 and ex 5407 69 90 (TARIC code 5407 69 90 10).
(b) Rate of Duty : 85.3% of the net, free-at-Community-frontier price before duty (except for 44 companies with individual duty rates ranging from 20.0% to 74.8%).
(c) Effective Date : 17 March 2005 (the duty will apply for 6 months).
(d) Collection of Duty : The release of the product for free circulation in the Community shall be subject to the provision of a security, equivalent to the amount of the provisional duty.
(e) Time Limit for Comments : Interested parties may make their views known in writing and apply to be heard by the Commission within 30 days from 17 March 2005.
