European Union (EU)* : Termination of the Investigation Concerning the Possible Circumvention of the Anti-dumping Measures on Imports of Certain Ring Binder Mechanisms Originating in the Mainland of China by Imports of the Same Products Consigned from Thailand, Whether Declared as Originating in Thailand or Not

Further to Commercial Information Circular No. 121/2004 of 12 May 2004, the European Commission (the Commission) has published a regulation to terminate the investigation concerning the possible circumvention of anti-dumping measures imposed on imports of certain ring binder mechanisms originating in the mainland of China by imports of the same products consigned from Thailand, whether declared as originating in Thailand or not. The Regulation also terminates the required registration on imports of certain ring binder mechanisms consigned from Thailand, whether declared as originating in Thailand or not. DETAILS

  1. On the basis of prima facie evidence that the anti-dumping measures on imports of certain ring binder mechanisms originating in the mainland of China were being circumvented by means of transhipment via Thailand, the Commission self-initiated a circumvention investigation on 29 April 2004.

The investigation revealed that the sole exporter of certain ring binder mechanisms in Thailand had to be considered as a genuine producer, and thus transhipment of certain ring binder mechanisms via Thailand had not taken place. In light of such findings, the Commission decided that the circumvention investigation should be terminated with effect from 25 December 2004. The required registration on imports of certain ring binder mechanisms consigned from Thailand, whether declared as originating in Thailand or not, should also be terminated on the same date.

BACKGROUND

  1. Definitive anti-dumping duties on certain ring binder mechanisms originating in the mainland of China have been imposed since 25 January 1997. Initially, the rate of duty for mechanisms with 17 and 23 rings was the difference between the minimum import price of ECU 325 per 1,000 pieces and the free-at-Community-frontier not cleared through customs price. The rate of duty for mechanisms other than those with 17 or 23 rings was 39.4% of the net, free-at-Community-frontier price before duty except for one company at 32.5%. Following an interim review, the rate of duty was revised on 6 October 2000. The revised rate for mechanisms other than those with 17 or 23 rings was 78.8% of the net, free-at-Community-frontier price before duty (except for one company at 51.2%) while the duty rate for mechanisms with 17 and 23 rings was maintained. The subject anti-dumping duties have been extended for another four years starting from 5 December 2004 subsequent to an expiry review.

Furthermore, based on the findings of a circumvention investigation, the Council has extended, with effect from 2 July 2004, the definitive anti-dumping duty imposed on imports of certain ring binder mechanisms originating in the mainland of China to imports of the same products consigned from Vietnam, whether declared as originating in Vietnam or not (TARIC codes 8305 10 00 11 and 8305 10 00 21).
