Commercial Information Circular No. 69/2004

European Union (EU)* : Result of Expiry Review of the Anti-dumping Measures on Imports of Silicon Originating in the Mainland of China

Further to Commercial Information Circular No. 210/2002 of 22 October 2002, the Council of the EU has published a regulation announcing the decision to maintain the anti-dumping duty imposed on imports of silicon originating in the mainland of China consequent to an expiry review. A copy of the regulation is at Annex (pdf format) for reference. Salient points are set out below-

(a) Product : Silicon classified under CN code 2804 6900 (this code is given for information only).
(b) Rate of Duty : 49% of the net, free-at-Community-frontier price before duty
(c) Effective Date : 5 March 2004

DETAILS

  1. The Council of the EU imposed on 17 December 1997 a definitive anti-dumping duty on imports of silicon originating in the mainland of China at a rate of 49% of the net, free-at-Community-frontier price before duty. On 9 September 2002, the Euroalliages (Liaison Committee of the Ferro-Alloy Industry) requested an expiry review alleging that there would be a continuation or recurrence of dumping and injury to the Community industry with the expiry of the anti-dumping duty. The European Commission initiated an expiry review on 12 October 2002.
  2. On the basis of the results of the review investigation, the European Commission concluded that dumping of the product concerned was currently taking place and that there would be likelihood of a recurrence of injurious dumping if the duty was repealed. The Council of the EU therefore decided to maintain the definitive anti-dumping duty imposed on the subject product.
